1. Acceptance of Terms

By downloading, installing, or using YourFit.ai ("the App" or "the Service"), operated by YourFit Inc. ("we," "our," or "us"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service.

2. Service Description

YourFit.ai is a fitness and wellness platform that provides:

• Workout tracking, exercise logging, and custom routine building
• Nutrition logging and calorie/macro tracking
• Sleep tracking and quality monitoring
• Step counting and activity tracking via device sensors and Apple HealthKit
• AI-powered fitness insights and recommendations
• Social features: posts, comments, follows, and direct messaging
• Premium subscription features (YourFit Pro)

3. Eligibility

You must be at least 13 years old to use YourFit.ai. By using the Service, you represent that you meet this requirement. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

4. User Accounts

To access the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Keep your login credentials secure and confidential
• Be responsible for all activity that occurs under your account
• Notify us immediately of any unauthorized account access at support@yourfit.ai

5. Health and Safety Disclaimer

By using the Service, you acknowledge that:

• You should consult a healthcare provider before starting any new fitness or diet program
• You participate in any exercise activities at your own risk
• YourFit Inc. is not liable for any injuries or health issues resulting from use of the Service
• You are responsible for understanding your own physical limitations
• You will stop exercising and seek medical attention if you experience pain, dizziness, or discomfort

7. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Harass, abuse, threaten, or harm other users
• Post or share inappropriate, offensive, or illegal content
• Share false or misleading health or fitness information
• Attempt to gain unauthorized access to any part of the Service or other users' accounts
• Scrape, reverse engineer, or copy any part of the Service without permission
• Use the Service for commercial purposes without prior written consent from YourFit Inc.
• Upload malicious code or interfere with the Service's operation

8. User-Generated Content

By posting content (posts, photos, comments, messages) on the platform, you:

• Represent that you own or have the rights to share the content
• Grant YourFit Inc. a non-exclusive, royalty-free license to display and distribute that content within the Service for the purpose of operating the platform
• Confirm your content does not violate third-party intellectual property rights
• Agree that we may remove content that violates these Terms or our Community Guidelines

9. Intellectual Property

The Service, including its design, code, brand, logos, and content created by YourFit Inc., is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand how we collect and handle your data, including health data from Apple HealthKit.

11. Service Availability

We strive for reliable service but do not guarantee 100% uptime. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for inconvenience or loss caused by service interruptions.

12. Limitation of Liability

To the maximum extent permitted by applicable law, YourFit Inc. and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, loss of profits, or personal injury — arising from your use of or inability to use the Service.

Our total liability for any claim arising from your use of the Service is limited to the amount you paid us in the 12 months preceding the claim, or $10 USD, whichever is greater.

13. Indemnification

You agree to indemnify and hold harmless YourFit Inc. and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your user content, or your violation of these Terms.

14. Account Termination

You may delete your account at any time in the app under Settings → Account → Delete Account. We may suspend or terminate accounts that violate these Terms, without prior notice. Upon termination, your right to use the Service ceases and your data will be deleted in accordance with our Privacy Policy.

15. AI Features

YourFit.ai includes an AI Health Coach powered by Google Gemini. By using this feature, you acknowledge that:

• AI responses are generated automatically and are for general informational purposes only — they are not medical advice
• AI recommendations may not be accurate, complete, or suitable for your specific health situation
• You should not rely on AI responses as a substitute for professional medical, nutritional, or fitness advice
• Your fitness data is transmitted to Google's servers to generate responses, as described in our Privacy Policy
• YourFit Inc. is not liable for any decisions made based on AI-generated content

16. Affiliate Program

YourFit.ai operates an affiliate program that allows approved participants to earn commissions by referring new subscribers. Participation is subject to separate Affiliate Program terms communicated upon approval. Key points:

• Affiliate status must be approved by YourFit Inc. and may be revoked at any time for violations of these Terms or the Affiliate Program terms
• Commission payouts are subject to a minimum threshold and verification period
• Affiliates may not use deceptive, misleading, or spam-based promotion methods
• YourFit Inc. reserves the right to modify commission rates and program terms with reasonable notice

17. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. YOURFIT INC. DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

18. Apple-Specific Terms

If you downloaded YourFit.ai from the Apple App Store, the following additional terms apply:

• These Terms are an agreement between you and YourFit Inc., not with Apple. Apple is not responsible for the App or its content.
• Apple has no obligation to provide maintenance or support for the App.
• In the event of any App failure to conform to applicable warranties, you may notify Apple and Apple will refund the purchase price (if any). Apple has no other warranty obligation with respect to the App.
• Apple is not responsible for addressing any claims by you or third parties relating to the App.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

19. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via in-app notification or email before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

20. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in court for intellectual property matters.

EU/EEA/UK Users: Nothing in these Terms limits your rights under applicable mandatory consumer protection laws in your country of residence. If you are an EU consumer, you may also have the right to bring a dispute before the courts of your country of residence and to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

Australian Users: Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms is intended to exclude, restrict, or modify any rights you may have under the Australian Consumer Law.

21. General Provisions

• Severability — If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary and the remaining provisions will remain in full force and effect.
• Entire Agreement — These Terms, together with our Privacy Policy, constitute the entire agreement between you and YourFit Inc. regarding the Service and supersede all prior agreements.
• No Waiver — Failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.
• Class Action Waiver — To the extent permitted by law, you waive any right to bring claims as a class action or in a representative capacity. All claims must be brought on an individual basis.
